Vietnam to fine of up to VND 100 M for energy use violations
Prime Minister Nguyen Tan Dung has promulgated a decree regulating fines on administrative violations relating to economical and effective energy use.
Forms of sanctioning administrative violations Decree 73/2011ND-CP include warning and fines of VND 1 - 100 million.
Administrative violations in energy efficiency and conservation include violations of regulations on energy audit, energy labeling, production, import and circulation of energy using vehicles and equipment, violations on energy efficiency in key energy consuming facilities.
According to Decree 73/2011ND-CP, a fine of VND 50-70 million shall apply to key energy consuming facilities that violate regulations on energy audit; a fine of VND 10-30 million and additional penalties depending on the seriousness of the violation shall apply to organizations that violate regulations on granting energy auditor certificate.
A fine of VND 10-30 million shall apply to acts of failing to comply with technical regulations and implement energy efficient technology management measures in industrial production.
Especially, a fine of up to VND 100 million shall apply to units who intentionally dot not reject obsolete technology and low-output electricity generators according to the schedule prescribed by the Government; those who build new generators with obsolete technology and low output; those who import equipment, vehicles which do not comply with technical regulations and energy consumption norms on energy efficiency and conservation.
This Decree shall take effect from October 15th 2011.
